Subject: Decision on a secret file from a voluntary organisation
 
 
A major life changing decision on a secret file from a voluntary organisation that uses my tax for huge concessions. This Mr Smart without any input from us believed the Catholic charity on a secret file that I was not allowed to see.

Smart said I could get a copy through the F.I.O, if that is not guilt then you tell me what is.


This society has a constitution and RULE that states all members can access any financial documents - we tried along with many others but Cairns society administrator Maree Fell refuses VOLUNTEERS access to any file involving money and she is a paid staff worker, this society states it must not only be run by Volunteers but been seen as being run by Volunteers.

Maree Fell's colleague on the Gold Coast stole over $200,000 from the poor so it should be asked why a Paid staff member refuses requests from this Voluntary Organisation members.


As we all know why she refuses to show statements because a life long society member exposed to Michael McKeon that Maree Fell has stolen at least $20,000 that is only what he knows.

It is supposed to be A VOLUNTARY ORGANISATION SO WHY ARE THEY USING OUR TAX.

I refer to your email dated 8 March 2007, in which you requested clarification on Vinnies Gym being closed based on an operational decision by St Vincent De Paul Society Queensland. 
I wish to draw your attention to the advice provided by Ms Liliana Pacey, Manager, Complaints and Prevention Unit (CPU) in her letter date 30 January 2007 in which it was advised that to assist CPU in the assessment process, St Vincent De Paul Society Queensland provided, in good faith, a copy of the review report undertaken by an independent consultant on the understanding that this report not be given to anyone other than to the CPU complaints officer and senior departmental staff. 

 

You may also recall that a recommendation has been made to St Vincent De Paul Society Queensland to consider forwarding you a copy of the report undertaken by the consultant. 

 

This recommendation was based on the view that if you are provided with the report it may clarify St Vincent De Paul Society Queensland's decision to close Vinnies Gym based on operational and staffing issues which were identified in the report.  

 

It was also emphasised that this is a recommendation only as CPU does not have the authority to ensure this action is taken.  

CPU is of the view that providing you with detailed information from the report provided by St Vincent De Paul Society Queensland would be without the permission of the society. 

 

 

 

It is suggested you contact St Vincent De Paul Society Queensland to request a copy of their report regarding Vinnies Gym as referred to in CPU's recommendation. 

 

You may also wish to make a freedom of information request for a copy of the report which is held on departmental records. 

 

This request can be forwarded to Administrative Law Coordination (Freedom of Information) Unit, Department of Communities, GPO Box 806, Brisbane QLD 4001. 

 

 It is the role of the Administrative Law Coordination Unit to determine the information that is able to be provided.

            I wish to re iterate the concerns I expressed at State Council meeting June 28 regarding the recent directive given to our Solicitors to instigate legal action against Ozcare by way of a letter of demand, to hand back our previously owned and operated facilities.

 

As a member of State Council Board, my understanding of the situation was that our Solicitors had primarily been engaged to investigate the matter of legal implication, and requirements necessary to recover these facilities.                                                    

        This would involve a process of compiling, packaging, and analysing a wide range and scope of historical documentation which we organised for them.                                                                                                         

It also included meetings and consultation with The Catholic Bishops of Queensland, members of the National Council and other various parties etc.

Our Solicitors were to then analyse this information and produce a Report for State Council, accompanied with a list of recommendations for our assessment and analysis.

 

When you announced at our meeting that a letter of demand had already been served, and that we had received a response back from the Ozcare Solicitors,                     

I immediately expressed my concerns that this had been a significant and decisive step, and that the full Council should have been informed and furthermore involved in the final decision of this action.

I then asked who had authorised this action, and the answers from the floor were given that Council had previously agreed to a motion that we would engage our Solicitors "to look into the matter of taking back the facilities from Ozcare and to follow their recommendations as such"

 

            As a director on this Board I believe that I am expected to act within the roles of responsibility, accountability, duty of care, and to act with due diligence.

We have now been advised that a major action has been instigated which no doubt will add significant outcomes and ramifications to our organisation; for better or for worse. Neither myself nor (as I assume) other members of this Board, have been consulted with on this matter, nor were we issued with a copy of the Solicitors Report and briefings.    

 

In conclusion we did not get the opportunity to participate in a thorough evaluation and debate to assist our Board to formulate an informed decision on such a major issue.

This recent happening concerns me greatly, and as a result of this

I hereby wish to officially place on the record, this notice to State Council; based on the grounds that I have not been kept updated and adequately informed on these matters, and that because pertinent information had not been forwarded to me for my perusal prior to this decision

 

"I neither agree with nor support this action of a 'Letter of Demand' which was served against Ozcare."

Tim O’Connor was the Qld St Vincent de Paul’s STATE PRESIDENT that Judith Tierney and Jim Tierney made the conditions of Jim Tierney’s donation of all the equipment that made up the St Vincent de Paul’s Fitness and boxing facility called Vinnies Gym.

 

St Vincent de Paul’s ceo Peter Maher closed Vinnies Gym to silence Jim Tierney after Jim Tierney informed Peter Maher of all the bullying and harassment going on within the society, and four witnessed statutory declarations being sent to Prime Minister John Howard three from the sacked Vinnies Gym instructors and Jim Tierney’s sent after the closing of Vinnies Gym.                                                

Judith Tierney sent an email to TIM asking him why he did not come forward and confirm he had accepted the conditions with my donation.

It is not a case that I have nothing to say but rather I have on involvement with the organisation or contact with anyone associated with that organisation

as many of the people who have wronged you and Jimmy have done the same to me  and I have no wish to have contact with them.

 

On  a personal level I am struggling to cope with my youngest son who has significant mental health issues including severe depression and anxiety complicated by  suffering from Asperger syndrome.

 

I think that you know  from your past professional background how demanding that can be on a family and trying to hold down a job.

 

On a personal level I injured back at work  and I now have a damaged back with ongoing pain and I also have a heart condition.

I wish you and Jimmy well for the future.

Judy, this does seam a fair way forward - indeed the indelibly next step and hopefully one

which will satisfactory conclude what has been unhappy time - to say the least for all

Yesterday I was told of a statement made by Mr McAuliffe about me to a friend of mine. He said, “She thinks she (me) is so clever, going to the Bishop, who doesn’t care anyway, and to the police”.                     

 

I am now aware that I am anything but clever; if I were I would have headed the warnings given to me when I first mentioned joining St Vincent de Paul.

 

I make no apology for contacting you as the local head of the faith I followed, and as a person I felt I could freely speak with.

 

As for the police, I am Jim’s official carer and where he goes I take him.

He was there after receiving advice that it was the proper course to follow.

 

Considering these remarks, I know that no productive outcome could be achieved by my meeting with Mr McAuliffe.

I will not be attending the meeting scheduled by your office for the 25th of this month. 

 

I would have been very surprised had this meeting gone as arranged, even without cancelling.

 

Procrastination seems to be the preferred option in this whole affair.

Bishop Foley contacted my wife again and promised McAuliffe would not be allowed to go if Jude would see him alone. Credibility John Wiener?

 

She went to see Bishop Foley alone - Bishop Foley asked where I wanted my property delivered too as he would meet all the transportation expenses.

 

“James” Jude said, “They took his autographed boxing photos he lent to Vinnies Gym for the kids down off the walls with crow bars”.

 

“They dismantled precision pin weight unit stacks that are not supposed to be dismantled once they are assembled worth thousands of dollars each with no knowledge of how to dismantle this equipment”.

They almost certainly are useless now, and besides it was not me that donated and erected Vinnies Gym it was Jim so should someone be talking to Jim.

 

Bishop James FOLEY said McAuliffe is terrified to meet Jim.

Jude said that’s his problem not mine I only came to tell you about Maher, McAuliffe and his very close friend Maree Fell’s behaviour.

 

So John I went to see Bishop James Foley and spent two and a half hours with him. He has again informed me the equipment is still and remains mine he is willing to have it removed at his expense to Church property as I am the ONLY ONE THAT KNOWS WHAT SHOULD BE THERE

 

As well as a HUGE AMOUNT OF OTHER CAIRNS RESIDENTS PROPERTY.

 

So what does McAuliffe do - he wants me to sign another GAGGING or as is document - so tell McAuliffe I do not have the luxury or indeed want it - to sign for other peoples property that is most probably missing.                                       

 

Like the fully commercial kitchen and gadgets that the ALH group donated to the GYM not the society – the kitchen that Maher said he bought to Dean Lock.

And because we can prove Maher and McAuliffe passed on lies, Maher should not be allowed to use donated money for the poor to keep covering his lying arse.

 

We understand anyone that knows this and does not appose it can be called as witnesses at a later date.

 

All official instructions to Society solicitors THYNNE & MACARTNEY are just that, INSTRUCTIONS.

 

Because these instructions were given by Maher we understand we are entitled to sue Maher and the Society.

 

So I will get all the publicity I have been denied.

 

But the best thing that came from this investigation is because Maher used the title of ceo and THE RULE of the Society recommends this title is not appropriate for a Voluntary Organisation, he takes all the hits because it was his instructions

 

[as a INDIVIDUAL] that THYNNE & MACARTNEY carried out and acted on even though it was technically via the Society.

So with me telling you this and you being a member of the society OFFICIALLY TOLD BY ME his legal defence fees cannot come from donated money for the poor, that he thought he could use indefinitely. 

I will subpoena anyone that knows the above.

 

He should now, pay his legal fees himself; simply because of the Constitution the Society has in place, or should follow to keep its tax concessions.

You see I told Jude when she first got involved with this sanctimonious pious group like maher McAuliffe Fell McKeown ect ect ect ect ect ect.

So it was no surprise to me that the society is not righteous and left behind years ago Fredric Ozanam philosophies regarding the poor as Bishop James Foley pointed out to me.

Credibility - why does the society have a policy to visit the needy and the sick yet Jude was left like a leper.

Dear John,

 

I am writing to you after having exhausted all other avenues. Communication between Brisbane and Cairns is for some reason out of reach, well for me it is anyway. Could you please let me know if you received all the paper work Jim sent to you? As he explained to you he suffers from PTSD and I am his official carer and he really needs to know what you think of all he told you, in particular the Statutory Declarations.

 

He is especially concerned about the public allegations made about him by the CEO.

 

I have asked him (the CEO) who said it to him his continual reply is no comment.

I asked him if he would tell Bishop Foley, again he said no comment and what difference would it make, and who is he anyway!!!!

 

The Qld. State President Mike McKeown repeated this allegation to me, Jim has taken on the responsibility of several young boxers, both male and female, and needs to clear his name immediately as this can affect his professional license.

 

I intend to ask Bishop Foley for his help when I see him on Friday. 

 

Now my reason for contacting you I assume that the Society as a whole and not just Queensland is looking to become involved with mental health issues.

 

You in WA are light years ahead of any thing here.

 

I was until recently a State Vice President, but resigned in disgust, I am however still a Society Conference member.

The story included with this letter appeared in the Cairns Post late last week. The figures given have I believe, been arrived at through a questioner that was sent out to Conferences.

The Conference to which I belong responded by saying we felt it would be demeaning to those we were assisting, if we were to guess their mental state.

 

I personally have several qualifications in the area of mental health and would not be prepared to make such a judgement under the circumstances.

 

I feel such guesses could be seen to be an invasion of ones life and that the Society would not have the right to make such assessment by unqualified people.

 

We all as you know have mannerisms that others may find strange or unusual but that usually does not mean we have a mental illness.

 

Apart from what I have just said, the appearance and timing of this article I found very suspect.

 

By which I mean it is only 2 weeks ago that the Cairns Diocesan Council closed Vinnies gym, which had many clients with mental health problems.

 

Several weeks before this closure I made a point of contacting the Diocesan President Jerry McAullife to ask if the gym was going to close, his answer was ‘absolutely not’.

I explained that I would prefer it not close, but if it was too, could as much notice as possible be given so anyone with any type of mental instability could be pre warned.

I explained that sudden changes to life can have a devastating effect on such people.

Without exception the members of the Cairns Diocesan council have never made any attempt to visit or have involvement with the gym or gym members. 

 

I have since the closure seen two of these people, one has been back to hospital and the other said he has had his medication increased twice in that short period of time.

A local Psychiatrist from the public health system was recently singing the praises of the gym, for his chronic schizophrenic patients.

 

Now I can only guess as to what is happening as no one will speak to me, but I do know that Gumba Gumba an indigenous group are trying to but together a business plan to be able to keep the gym open at its present address, until Feb. 2006 when the lease runs out, but for some reason Mrs Fell will not provide numbers they need.

 

 

This would be of assistance to the Society as the owner intends to hold to the lease arrangements.

These arrangements were made between the Diocesan President and a member of the Aboriginal Elders, and all seemed to be going well until Mrs Fell returned from holidays.

 

This particular Elder told me he has attempted to contact Brisbane, the CEO who said the now infamous words that ‘life’s tough’ when asked about the mentally ill.

 

He is right of course life is tough, but it is much tougher for some than for others.

He, (the Elder) is another one who no one will answer.

 

If you happen to be speaking to any one from Brisbane you might like to tell them, that one of the very first young boys who started boxing at the gym, taught by Jim, on Saturday last he won a State title.

His next goal is a National title.

He was always happy to say he trained at Vinnies Gym and was an excellent young face to the Society.

 

To finish off, how do I answer people, local Council members and business people when asked what is to happen to the different things they gave to the Gym not the Society?

 

These same people now know about the Statutory Declarations and the $130 million and wonder why a Charity with so much money says the can’t afford to keep a programme like the Gym open when it has such a good influence on so many. 

 

Will you please have a word with McAuliffe about the removal of the equipment, as it has become very personal between Jim, CEO Maher, McAuliffe and Fell.

Jim says he is not putting up with much more of it.

 

I will try and resolve this with the Bishop but your help and intervention will I am sure save what little face the Society now holds here in Cairns.

John barrister friends of mine in Liverpool have scrutinized the RULE and the CONSTITUTION of the society I wonder have you.

Just for starters I have the below document in the hands of my people waiting for my instructions they find it very interesting as a ceo that should not be even allowed to use the title a ceo in a Voluntary Organization to use Jude’s and my tax telling bare faced lies again -

My friends made several official written complaints from Liverpool to the Government controlling body of the law Society here in Queensland.

Because the law Society agreed that Maher [individual] and McAuliffe [individual] exacerbate my condition and caused Judy to have a nervous breakdown they advised us that we could primarily sue Maher and the Society separately.

 

The reason the THYNNE & MACARTNEY solicitors get away with any retribution is simple - by law they only follow instructions it is not them that officially say anything [IT IS AN INDIVIDUAL]  to anyone it is Maher as he

I would like to know by whom and when I was requested to show my PROFESSIONAL BOXING LICENSE.

From the time the fitness centre opened which was well before maher was employed by the society, not at any time have I been asked to produce my PROFESSIONAL BOXING LICENSE.

Are you aware that a PROFESSIONAL BOXING LICENSE IS A PRIVILEGE to have not a right?

If asked, would anyone think a HOLDER OF A PROFESSIONAL BOXING LICENSE would want to hide it?

 

And for your information it was I at a meeting with some of your clients that made them aware of the insurance needed.

 

TO MORE IMPORTANT THINGS I want the name of the person that maher alleges told him I JAMES VICTOR TIERNEY KING HIT A CHILD.

 

The same statement that the QLD State President (‘the society’) McKeown said maher had told him!

Any one with an ounce of sense would know one of them is wrong. 

 

HOW DARE YOU PEOPLE SAY I DONATED A NUMBER OF ITEMS OF GYMNASIUM EQUIPMENT are you publicly saying you are now qualified to make statements of what constitutes a fitness centre?

 

How dare you!!!  

 

If you are trying to INTIMIDATE me REGARDING the alleged INCIDENT THAT you state ****OCCURRED ON JUNE 8TH 2005.

 

AS CLINT EASTWOOD SAID,

Because these instructions were given by Maher we understand we are entitled to sue Maher and the Society.       

 

  But the best thing that came from this investigation is because Maher used the title of ceo and THE RULE of the Society recommends this title is not appropriate for a Voluntary Organisation, he takes all the hits because it was his instructions [as a INDIVIDUAL] that THYNNE & MACARTNEY carried out and acted on even though it was technically via the Society.

He should now, pay his legal fees himself; simply because of the Constitution the Society has in place, or should follow to keep its tax concessions.

You see I told Jude when she first got involved with this sanctimonious pious group like maher McAuliffe Fell McKeown ect ect ect ect ect ect.

So it was no surprise to me that the society is not righteous and left behind years ago Fredric Ozanam philosophies regarding the poor as Bishop James Foley pointed out to me.

Credibility - why does the society have a policy to visit the needy and the sick yet Jude was left like a leper.

 2 -PAID Maher ceo told everyone in Cairns he personally sent to me Registered letters banning me from the gym - the same gym that I donated, erected and run with no corporate salary for four years credibility?

I would have thought a ceo would have known you have to sign for registered letter credibility?

 

3 - I spent a lot of money building a boxing ring and weights for the gym in Ravenshoe.

Why you may ask because I have cared for disadvantaged kids all my life -

Les Smith suckered me in again asking me would I set up a gym in Ravenshoe because the kids were using a derelict railway shed to box - and he was scared they may be killed using this shed all the time. 

Jude had $100,000 released by state council to build a building on the society's land when it was finished she went with Marc King to Ravenshoe.

The building was changed so much from plans submitted to local council it was not passed. When asked why they had changed it their reason given was                                

 

 "We are not having that pommie BASTARD coming up here telling us what to do"                 

 

 

of course I never heard from Les Smith again. Credibility?

The people that stole this building from the kids have a computer business so realised they could supply and maintain computers in the building set up for a gym so I lost more money with this society credibility?

 

 4 - How would John Wiener like being called an Aussie BASTARD living in Liverpool and spending huge amounts of money helping English kids credibility?

 

 5 - How would John Wiener feel about credibility if every his wife Pat Wiener went out the door she was pulled up getting called a Catholic thief and being screamed at "Give us our property back". While the thief hides in the hills away from this behaviour credibility.

 

 6 – What would John Wiener think if a man [McKeown] professing to be a man of God and a state president borrowed a very valuable collectible book while getting fed in his home and was told it was part of his collection yet even after telling the police holy Joe still will not return my priceless book credibility.

 

 7 - How would Pat  Wiener feel about credibility if she had to repeatedly tell a society paid staff WPH&S representative Peter O'Shaunessy to stop playing with his genitals and holding and rubbing his balls every time she stood in front of this creature?

 

When Rhonda Wallace [depot manager] and Jude followed the correct procedure and gave to Maree Fell - official documents of complaints she was to give to the police because [We understand this lewd act is a criminal act] Maree Fell did not do anything with these officials’ documents.

And to make matters worse this creature started rumours that Rhonda Wallace [depot manager] was a lesbian and should not be working for a Catholic charity - this rumour was helped along by Maree Fell bullying Rhonda Wallace to submission and Rhonda resigned.

Rhonda has this all documented by WPH&S and Kerry Shine attorney general - Rhonda saved her sleeping tablets she got for the bullying then went and bought a hose to connect to her car to kill herself credibility John.

 

How would Pat Wiener feel about  credibility John if Maree Fell went around and lied to all the women in the shops in Cairns stating Jude [IN YOUR CASE PAT] did not want to DO THE OLD WARES AND SALES anymore.

Maree Fell then with her conspirator McAuliffe called a store coordinators meeting were a unanimous decision to stop all the OLD WARES & SALES was agreed.

 

When the ladies in attendance at that meeting found out that Maree Fell and McAuliffe conspired to stop Jude doing this old wares business they came around to my home crying, one 84 year old lady was sobbing to me calling herself St Peter what ever that means.

 

John answer me this question if your wife PAT had this deliberate damage done to her and yes it was deliberate would you be worrying about credibility.

 

If McAuliffe was and is still continually making defamatory statements about YOUR MENTAL HEALTH to people he thinks will not repeat it to me would you be concerned about credibility.

 

Now the real reason for the [St Vincent de Paul desperately empty depot] after the Cairns community found out about McAuliffe and Cairns administrator Maree Fell’s conspiracy, and bullying of women- Francine Kubanek –Judy Tierney- Rhonda Wallace ect ect-                       

 

Judy Tierney was a very popular Diocesan president and even more popular Qld Vice president.

When the lady volunteers found out what the real McAuliffe and Maher and Fell were like – they did what any decent person would do they abandoned these evil bastards.

Having Peter O’Shaughnessy on the front page of the Cairns Sun did not help as this is the man that started the rumours that Rhonda Wallace was a lesbian and should not work for a Catholic charity.

Rhonda Wallace put in an official complaint to Cairns administrator Maree fell after asking O’Shaughnessy to stop doing this obscene act in front of her

Judy Tierney also put in a official complaint about O’Shaughnessy to Maree Fell after she asked him to stop playing with his genitals while she was seated in her car.

The women wonder if it has any thing to do with Peter O’Shaughnessy being a St Vincent de Paul WPH&S representative.

 

They know this obscene act is unlawful.

 

Just see what the Gold Coast SVDP branch did with their donated money for the poor.

St Vincent de Paul Society Queensland president Michael McKeown resigned after the Witnessed Statutory Declarations stating the reason this charity closed their facility and their consistent bulling was made public. Credibility.

YOUR COMPLAINT DATED 14 JULY 2006 ABOUT THYNNE & MCCARTNEY SOLICITORS

 

I refer to the Commission's previous letter to you dated 10 July 2006 and advise that I have now had the opportunity to consider your complaint in detail.

 

In essence, your complaint is that Thynne & McCartney Solicitors slandered and made a false statement about your husband, Mr James Victor Tierney. You have stated that the actions of Thynne & McCartney caused you and your husband unnecessary stress and exacerbated Mr Tierney's mental health condition.

 

The regulatory scheme under the Legal Profession Act 2004 ("Act") enables my office to investigate complaints about legal practitioners "professional misconduct" or "unsatisfactory professional conduct" as defined in the Act. I have the power to consider taking disciplinary action only where conduct falls

within either of these statutory descriptions.

 

As you can appreciate, I have an obligation to make my decisions according to the provisions of the Act. The test that I must apply to determine whether or not to bring disciplinary charges is whether, on balance, there is a reasonable likelihood that a disciplinary body would find the solicitor guilty of professional misconduct or unsatisfactory professional conduct.

 

I will deal separately with each aspect of your complaint below.

 

Making False Statements

 

You have asserted that Thynne & McCartney made a false statement about Mr Tierney in that they stated that Mr Tierney had previously been requested to provide a copy of his boxing trainer licence.                       I note particularly the wording of their letter:

 

"However, as your client has failed (despite request) to produce a copy of his license, the Society has not been able to verify that claim".

On my reading, these words that the St Vincent de Paul Society (the Society) has made previous                requests to see Mr Tierney's license. I understand that in making this statement, Thynne & McCartney would have been acting on the instructions of their clients, the Society. The role of a legal practitioner is to advise theirs clients and, within the boundaries of professional conduct rules and standards, act on their clients instructions. As Thynne & McCacartney do not act for you, at law, I am not able to compel them to provide evidence of their clients instructors or advise. I appreciate Mr Tierney’s circumstances and respect his opinion that the statement was intentionally false. 

 

Slander

 

The Act does not allow me to make determinations as to whether a party is guilty of slander. That issue must be dealt with by a court of appropriate jurisdiction and I must work within the powers given to me under the Act.

 

It may be in your interests to consult a legal practitioner to determine whether you have any right of claim against Thynne & McCartney or any other party and the likely success of any subsequent claim.

 

Additional Matters

 

I also note that your complaint raises concerns regarding Thynne & McCartney's failure to provide clarification or explanation as requested.

 

As I have highlighted above, Thynne & McCartney must comply with their clients' instructions, within the boundaries of professional conduct rules and standards. As such, Thynne & McCartney cannot provide responses to your requests for clarification or explanation unless so instructed by their clients.

 

 

 I sympathise that the conduct of Thynne & McCartney and their clients, the St Vincent de Paul Society, has caused you and your husband distress and affected your husband's health. However I must act in accordance with the powers given to me under the Legal Profession Act 2004.

The Society being a Voluntary Organisation by their Constitution & RULE for TAX purposes must always be controlled by voluntary people.

 

This is a St Vincent de Paul highly paid ceo telling me a volunteer and chairperson of the St Vincent de Paul "Vinnies Gym" special works that donated all the equipment with specific conditions to Qld St Vincent de Paul State president Timothy O’Connor.                                  

 

Set it up alone, and run for four years.

 

This Qld society ceo lied and defamed me stating he had sent a registered letter to me banning me the gym because I king hit a child.

 

No such letter ever arrived at my address.

 

When this so-called ceo realised he could not bully me he had to cover his lies and this was the letter he used. 

 

Indeed I also blew the whistle on St Vincent de Paul officials to the Prime Minister John Howard. Also to Qld Work Place Health & Safety not that they responded.

The spirit of poverty requires that the Society does not encumber itself with ownership of property unless it is proven to be necessary to the work. It does not expend funds on real estate as a capital investment and prefers to lease rather than purchase where economically viable.

The legal signatories of the Society are either trustees or members of incorporated bodies representing the national or their respective state councils. They must be members of those councils and act only with the approval of the council concerned.

It is incumbent on state councils to investigate all such proposals in relation to the need for such a work, suitability of site, design of building and capacity to pay. There is no Society rule which prevents state councils from borrowing but it is expected that arrangements for repayment will take into account funds normally required by conferences and other special works.

DECISIONS OF NATIONAL COUNCIL

          EMPLOYEES AS OFFICE BEARERS

Members who are employed by the Society cannot occupy the offices of president, vice-president, treasurer or be a member of the council, conference or committee responsible for their employment, or of a council at a related higher level. They may be an employee of one regional council and a member of another but to be a member of the same council or the diocesan or state council to which it is attached, places them in a privileged position as an employee which in some circumstances would give the impression of being both employer and employee.

CHURCH OR CIVIL HONOURS

The acceptance of honours by members for Church or charitable activity is a personal decision. However, in furtherance of a spirit of humility which has always been a feature of the Vincentian vocation, members should not recommend other members for public recognition in this way.           PROCEDURES FOR OVERSEAS VISITS BY

          SOCIETY MEMBERS

(a) Private Visits      .

Many members in the course of overseas holidays or business trips wish to contact their twinned conferences. This is to be encouraged. In making such visits, Society members must ensure that they do not use Society members as cheap tour guides. .

Members making such visits are asked to advise the national council, through their state council, of their intention of making such a visit. In this way the national council in the country being visited can be made aware of the proposed visit. This saves any embarrassment to the visitor or Society members in the country being visited and facilitates the

making of arrangements by the Society in the country being visited.

Members should never make any such visit without previously making arrangements with the Society in the area being visited.

(b) Society Visits

The following procedures are set out not to prevent or discourage visits but to get maximum benefit out of them with a minimum amount of effort from Society members O\Ief'S8aS.

1. Before plans for a visit are made the national council must be informed. This is to be done through the appropriate channels and when a council passes on the inforrr1ation to its next council it should add its comPleOIs and recommendations about the proposed visit.

2. The national council will contact the national counci          the
